We accept various forms of payment as specified in your service agreement. Late payments may result in suspension of services and may incur additional fees.

5. Intellectual Property

Upon full payment for services rendered, you will own the rights to the content you provided and the final website design. However, Nearsite retains the right to any pre-existing materials, templates, code libraries, and tools used in the creation of your website.

You grant Nearsite permission to use your completed website in our portfolio and marketing materials.

6. Website Maintenance and Support

If you subscribe to our ongoing maintenance and support services, the terms of that service will be outlined in a separate agreement. We reserve the right to modify or discontinue maintenance services with appropriate notice.

7. Client Responsibilities

You are responsible for:

  • Providing timely feedback and necessary content for your website
  • Maintaining the security of any login credentials we provide
  • Ensuring that all content you provide does not infringe on any third-party rights
  • Complying with all applicable laws and regulations in your use of the website

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEARSITE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF OUR SERVICES.

9. Warranty Disclaimer

OUR SERVICES ARE PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

10. Termination

Either party may terminate the service agreement according to the terms specified in that agreement. Upon termination, you remain responsible for any outstanding payments for services rendered.

11. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will notify clients of any material changes. Your continued use of our services after such modifications constitutes acceptance of the updated terms.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
